End User License Agreement

1. Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("Licensee") and VerdantStack ("Licensor") for the use of the Multi-tenant SvelteKit Starter software package ("Software").

By purchasing or using the Software, you agree to be bound by the terms of this Agreement.

2. Grant of License

Subject to the terms of this Agreement, Licensor grants you a non-exclusive, non-transferable, single-seat license to:

• Use the Software in production environments
• Modify the Software for your own projects
• Create derivative works based on the Software
• Build unlimited projects with your license (one seat = one developer)

3. Restrictions

You may NOT:

• Resell, sublicense, or distribute the Software to third parties
• Share your license key or access credentials with others
• Use the Software with multiple developers without purchasing additional licenses (licenses are per developer, not per project)
• Remove or alter any copyright notices or license terms
• Claim authorship of the original Software
• Resell or redistribute the Software, or build a competing starter kit / boilerplate product from it (building your own end product is always allowed)

4. Single Seat License

Each license entitles one (1) developer to use the Software.

• Individual License: One developer, unlimited projects
• Team License: Available upon request for teams of 2+ developers (contact support)

5. Ownership

The Software and all intellectual property rights therein remain the exclusive property of VerdantStack. This Agreement does not transfer ownership of the Software to you.

6. Updates

Your license includes updates for the life of the product.

• Updates include bug fixes, security patches, and minor improvements
• Major version upgrades may require separate purchase

7. Refund Policy

You may request a full refund within thirty (30) days of purchase, no questions asked.

8. Updates & Support (Lifetime)

Your one-time license includes lifetime updates to the Software as defined in Section 6 and lifetime standard support via email (verdantstack@proton.me) with a target response time of 48 hours (async only) — for the life of the product while your license is active and in good standing.

Included:

• Installation assistance
• Bug reports and fixes for the Software
• Usage questions about the Software itself
• Lifetime updates as defined in Section 6

Not included:

• Custom development, consulting, or implementation services
• Support for modifications you make to the code
• Support for a different VerdantStack product — each kit is a separate product requiring its own license
• Guaranteed availability of specific features, timelines, or roadmap items

VerdantStack will make commercially reasonable efforts to maintain and improve the Software but makes no binding commitment regarding the scope, frequency, or nature of updates.

Support is provided while your license is active and in good standing; revoked or refunded licenses lose support and download access.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE SOFTWARE.

LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SOFTWARE.

11. Termination

This Agreement is effective until terminated. Licensor may terminate this Agreement if you fail to comply with any term of this Agreement.

Upon termination:

• You must cease all use of the Software
• You must destroy all copies of the Software
• No refund will be provided for violation of terms

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction of the seller's principal place of business.

13. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.
